Dan Costello and Shipra Mehta won summary judgment on a traffic construction case with demands totaling over $75 million for six plaintiffs in the Circuit Court of Cook County. The case involves 24 separate construction defendants on an interstate rebuild where a commercial vehicle flipped over; killing or significantly injuring all of the passengers in the vehicle. Dan Costello has served as lead defense counsel and head of the defense steering committee on this case for the last four and half years.
The presiding judge ruled that the driver of the commercial vehicle was the sole proximate cause of the party’s injuries. This resulted in the dismissal of all construction defendants from the case. Shipra Mehta was key in drafting the motions and preparing for the oral argument. The matter is now on appeal in the 1st District Appellate Court.
